Agreement
Acceptance of These Terms
These Terms of Use constitute an agreement between you and Criterion Capital, LLC, operating the CoachRoyce practice. In these terms, “CoachRoyce,” “we,” “us,” and “our” refer to Criterion Capital, LLC in connection with the CoachRoyce website and services.
By accessing or using coachroyce.com, you agree to these Terms of Use and our Privacy Policy.
Do not use the website if you do not agree to these terms.
Website Purpose
General Information and Inquiries
The website provides general information about CoachRoyce, Royce Palazzo, coaching programs, fitness and performance concepts, Engineered Fitness, and ways to contact us.
Website content is provided for general informational and educational purposes. It is not an individualized training, nutrition, medical, rehabilitation, or healthcare program.
Important Health Notice
Not Medical Advice
CoachRoyce is not a medical practice, and website content does not constitute medical advice, diagnosis, treatment, rehabilitation, physical therapy, mental-health advice, or emergency guidance.
The website is not a substitute for advice from a physician or another appropriately qualified healthcare professional.
Consult a qualified healthcare professional before beginning or materially changing an exercise, nutrition, weight-management, or physical-performance program, particularly if you:
- Have an existing medical condition
- Have experienced a recent injury or surgery
- Take prescription medication
- Are pregnant or recently postpartum
- Experience pain, dizziness, fainting, or unusual symptoms
- Have been advised to restrict physical activity
- Have concerns about whether exercise is appropriate for you
Emergencies
Do not use the website, email, or an online form for an emergency. If you believe you are experiencing a medical emergency, call 911 or the appropriate local emergency service immediately.
Physical Activity
Risks and Personal Responsibility
Exercise, athletic activity, nutrition changes, weight management, and performance training involve risks. These may include soreness, fatigue, falls, strains, aggravation of an existing condition, illness, injury, and, in rare circumstances, serious harm.
You are responsible for deciding whether and how to act on general website information and for obtaining appropriate professional clearance when needed.
Stop an activity and seek appropriate professional care if you experience symptoms or circumstances that make continued participation unsafe.
Any participation in an actual CoachRoyce coaching program will be governed by a separate written agreement, assessment, informed-consent documentation, and other program-specific terms.
Coaching Relationships
No Client Relationship Created by the Website
Visiting the website, sending an email, completing a contact form, or submitting a preliminary assessment does not create a coaching, advisory, confidential, fiduciary, medical, or other professional relationship.
A coaching relationship begins only after:
- CoachRoyce accepts the engagement
- The parties enter into the required written agreement
- Applicable assessments and disclosures are completed
- Fees and program terms are agreed upon
We may decline an inquiry or prospective engagement when we determine that the program is not appropriate, capacity is not available, required information has not been provided, or another professional would be better suited to the individual’s needs.
Separate Agreements
Coaching Services, Fees, and Commitments
Coaching services are individually designed and may vary according to goals, condition, schedule, location, program, technology, and level of support required.
Fees, payment terms, program duration, scheduling, cancellations, rescheduling, communication expectations, use of coaching platforms, and termination rights will be stated in a separate agreement.
If these Terms of Use conflict with a signed coaching agreement, the signed coaching agreement controls with respect to the coaching services covered by that agreement.
Results
No Guarantee of Results
Fitness, health, body-composition, strength, mobility, vitality, athletic, and performance results differ among individuals.
Results may depend on factors including:
- Starting condition and training history
- Age, health, genetics, and physical limitations
- Consistency and effort
- Nutrition, sleep, recovery, and stress
- Program adherence
- Medical circumstances
- Factors outside the control of CoachRoyce
We do not promise or guarantee any particular result, outcome, timeline, weight change, appearance, level of fitness, business performance, athletic achievement, or health benefit.
Testimonials, examples, photographs, or descriptions of past performance are illustrative and do not guarantee that another person will achieve the same or similar results.
